The court recognized the illegality of the subsistence minimum in Ukraine

The Kiev Court of Appeal has found that the subsistence minimum in Ukraine (1777 UAH) is illegal, news.finance.ua reports.

The relevant decision was taken by the court on Tuesday, September 11.

In this regard, the head of the “Open Court” project Stanislav Batrin said that the court announced an initiative to form a new “market basket” and revise the subsistence minimum in Ukraine.

“On September 11, 2018, the Kiev Court of Appeal, composed of judges: Bezimennaya N.V., Kuchma A.U., Alimenko V.А. examined the case No. 826/5661/16 and decided to comply with the demand of Stanislav Batrin, the head of the “Open Court” project, to the Cabinet of Ministers of Ukraine, with the participation of third parties: the Ministry of Healthcare of Ukraine, the Ministry of Social Policy of Ukraine, the Ministry of Economic Development and Trade of Ukraine, the Ministry of Finance of Ukraine, – about the illegality of setting the subsistence minimum in Ukraine,” – this message said.

The plaintiff also noted that court decisions had already entered into force in two categories of the case: the illegality of the “market basket” in Ukraine and the establishment of the subsistence minimum in the state by the government.

“Due to the above-mentioned court decisions, the “Open Court” project announced an initiative to form a new “market basket” and revise the subsistence minimum in Ukraine – which must meet the requirements for ensuring constitutional guarantees for a decent living standard,” – Batrin stated.
